An amendment is required to the original Officer Decision Record relating to the Patching 2019 Framework Contract. This is due to the subsequent non-acceptance of Intention to Award letters issued to Premier Road Surfacing for Lots 1 and 3. It is understood that this decision was made due to concerns regarding the amount of investment required to take on the position of Lead Contractor in all three lots. Lot 2 is unaffected as both Premier Road Surfacing Limited and Thomas Bow Limited have confirmed acceptance of the Council’s Intention to Award.

In accordance with contract documentation, procurement rules and discussion with Commercial Specialist, the Council has reassessed the tender evaluation scoring to arrive at revised awards for Lots 1 and 3.

The appointment of Premier Road Surfacing Limited (Lot 2) and Thomas Bow Limited (Lots 1 and 3) as Lead Contractors still offers potential savings compared against comparable services offered under the current patching contract. It is proposed to allow this award to continue through the original ten-day standstill period.

The appointment of Thomas Bow (Lot 2) and Jordan Road Surfacing Limited (Lots 1 and 3) as Reserve Contractors will provide resilience for the service and competition when considering new Pricelist items.

Excellent quality submissions were received from all three contractors to back up their submissions – Thomas Bow scored highest in quality.

The County Council’s Treasurers financial checks have been completed on Premier Road Surfacing Limited and Thomas Bow Limited with both Contractors meeting the requirements – Jordan Road Surfacing is the current contractor but will be re-checked prior to any award.

To rescind and replace the originally approved Officer Decision Record of 5th February 2019 for the appointment of contractors to Lots 1, 2 and 3 of the Patching 2019 Framework Contract and appoint as follows:
Lot 1 - Thomas Bow Surfacing Limited (Lead Contractor)
Lot 1 – Jordan Road Surfacing Limited (Reserve Contractor)
Lot 2 - Premier Road Surfacing Limited (Lead Contractor)
Lot 2 - Thomas Bow Limited (Reserve Contractor)
Lot 3 - Thomas Bow Surfacing Limited (Lead Contractor)
Lot 3 - Jordan Road Surfacing Limited (Reserve Contractor)

Alternative options considered:

The revised arrangements offer greater resilience and better opportunities to compare performance of Contractors against each other.
